MarketRJ Justice Returns Search Query in Americanas EMail

A Rio de Janeiro judge yesterday (2) rejected a search and seizure request on emails from current and former Americanas executives for reasons of efficiency, in a new development of the crisis resulting from the discovery of an accounting violation at the retailer.

The search and seizure was approved by Judge Andrea Palma, of the São Paulo Supreme Court, last week, at the request of Bradesco. However, Judge Alexandre de Carvalho Mesquita, of the Second Commercial Court of Rio de Janeiro, decided to reinstate the judicial letter of request – used in communication between judges from different states.

“The action granted by the reckless court is outside its jurisdiction,” the decision read.

Also in recent days, in the decisions of the judge in Sao Paulo, Americans has rejected a search and seizure appeal, but at the same time it has managed to keep the evidence collected secret.

Americanas is headquartered in Rio de Janeiro. The company filed for judicial reorganization in the same state last month, facing a crisis resulting from the discovery of an accounting gap of more than R$40 billion.
